If you don't want the shirt you won, you can check the bidding history, and contact other people you beat and ask if they want it. If someone else is willing to buy the item i think the seller will let you go...

Well you may try to ask the seller to cancel the order because it is not "real". Or report to eBay if you want... Not sure how eBay will deal with it though...
The other option is to buy it anyway and sell it back on eBay after a few weeks...

but y didnt him just put on sale with the original one...i would be appreciate if tht was the case.

If I were you and if I can't make someone else to buy it from the seller, I would rather keep my 100% positive feedback record and buy the shirt and wait a few weeks before selling it again.

I'm not quite sure about this... because there's always a risk in re-selling and there's a fair bit of money involved.
As a buyer I'm always wary (not always aware though, I must say) of any re-selling, thinking there must be something wrong with the item.

there was one time, after I won a bid on a shirt, I found out the team/player never worn that shirt before, just like your case. So I offered to pay the seller 5 euro to compensate him by not buying the shirt. The seller accepted it and I just pay him 5 euro.
