John and May are good friends. May tells John about the latest generation of “smart computer” which are designed to be faster, interactive, and have state of art accounting abilities. John, who knows nothing about that, asks May to help him find a second-hand “smart computer” which can help him to solve complex accounting problems.
May is not an expert but she is knowledgeable about such “smart computers” as she had worked for two years with the producer. May finds a second hand “smart computers” which is repaired and upgraded to solve accounting problems. She recommends it to John. She claims it is in good condition, has never been repaired, and that it will solve John’s problems. May tells John that there is no need to get it checked by an expert computer engineer.
John buys the “smart computer” for $25,000 from the second-hand computer dealer. He found that the “smart computer” is totally useless. It cannot help him solve any accounting problems. As a result, he loses a million-dollar contract with a firm with which he is doing business.
John wants to sue May for damages for the negligent statement which has caused him such a huge loss. Advise John.
