Announcement of Transfer of Shinji Okazaki to VfB Stuttgart(英訳)

On February 13, 2011, Shimizu S-Pulse made an announcement with respect to the transfer of Shinji Okazaki to VfB Stuttgart, as follows:
On January 30, 2011, VfB Stuttgart (Bundesliga, Germany) announced that Stuttgart entered into a player contract with Shinji Okazaki.
S-Pulse congratulates Shinji Okazaki on attracting attention from such an esteemed club and feels this is a great achievement. However, the announcement has caused S-Pulse some embarrassment, as its agreement was not sought before it was made.
All transfers of players, including Shinji Okazaki, must be done in accordance with the players' contracts and FIFA Regulations. In relation to the transfer of Shinji Okazaki, two material breaches of the FIFA Regulations have occurred as a result of Stuttgart's actions. First, contrary to Article 18.3 of FIFA's Regulations regarding the Status and Transfer of Players, Stuttgart neglected to inform S-Pulse before entering into negotiations with Shinji Okazaki.
Secondly, Stuttgart entered into the player contract with Shinji Okazaki effective from January 31, 2011, in spite of the fact that the player contract between S-Pulse and Shinji Okazaki was valid until January 31, 2011. In order to enter into a contract with a player while the player's contract with his former club is still valid, pursuant to Article 18.5 of FIFA's Regulations on the State and Transfer of Players, Stuttgart (as the new club) and S-Pulse (as the former club) must enter into an agreement regarding the payment of compensation for the early termination of the contract between Shinji Okazaki and S-Pulse. Stuttgart's player contract with Shinji Okazaki is therefore against Article 18.5 of the FIFA Regulations and can not be permitted.
S-Pulse represents, and has the support of, its shareholders, supporters, sponsors, players, staff and many other people and related parties. S-Pulse thus cannot be seen to be allowing the transfer of a player which is against FIFA Regulations. S-Pulse has clearly explained its position on this subject to Stuttgart and the Japan Football Association. S-Pulse will also seek an opportunity for FIFA to apply the FIFA Regulations correctly.
S-Pulse sincerely wishes for the timely resolution of the problems relating to Shinji Okazaki's transfer so that Shinji Okazaki may play football in Bundesliga. S-Pulse is therefore exerting every effort to solve these problems.
